REGULAMIN PROGRAMU POLECEŃ

§1 Postanowienia ogólne

1. Organizatorem Programu Poleceń („Program”) jest The Burman Robinson Sp. z o.o. z siedzibą w Warszawie, wpisana do KRS: 0000750545, NIP: 5252764840, dalej zwana „Organizatorem”.
2. Program skierowany jest do osób fizycznych pełnoletnich, posiadających zdolność do czynności prawnych.
3. Celem Programu jest nagradzanie osób za polecanie usług Organizatora swoim znajomym i bliskim.
4. Program obowiązuje do odwołania przez Organizatora.

§2 Zasady uczestnictwa

1. Uczestnik Programu („Polecający”) może wziąć w nim udział poprzez przekazanie kontaktu do osoby trzeciej („Polecony”), zainteresowanej usługami Organizatora.
2. Polecony musi:
   1. być nowym Klientem Organizatora (niezarejestrowanym wcześniej w systemie),
   2. skorzystać z płatnej usługi Organizatora oraz w całości ją opłacić.
3. Polecenie uznaje się za skuteczne, jeśli Polecony zawrze umowę z Organizatorem oraz dokona pełnej płatności.
4. Organizator potwierdza spełnienie warunków drogą elektroniczną (e-mail/WhatsApp).
5. Do Programu nie kwalifikują się polecenia samego siebie, członków rodziny, ani osób już znajdujących się w bazie klientów Organizatora.
6. Do Programu kwalifikują się wyłącznie polecenia dotyczące usług:
   1. uzyskania karty pobytu czasowego / stałego / obywatelstwa,
   2. rejestracji / wniesienia zmian / likwidacji działalności gospodarczej lub spółki.

   Polecenia innych usług nie są objęte Programem w tym miesiącu.

§2a Przystąpienie do Programu

1. Do Programu może przystąpić każda osoba fizyczna spełniająca warunki z §1 ust. 2, niezależnie od tego, czy jest Klientem Organizatora.
2. Aby przystąpić do Programu, należy:
   1. zgłosić chęć udziału poprzez wiadomość e-mail lub WhatsApp do Organizatora,
   2. zapoznać się z niniejszym Regulaminem i zaakceptować jego treść, przy czym akceptacja może nastąpić w jednej z poniższych form:
      • zaznaczenie odpowiedniego pola w formularzu online,
      • przesłanie wiadomości e-mail lub WhatsApp o treści potwierdzającej akceptację Regulaminu,
      • przekazanie pierwszego polecenia, co jest równoznaczne z akceptacją Regulaminu.
3. W przypadku zgłoszenia przez Poleconego, że jego dane zostały przekazane bez zgody, Organizator usuwa dane Poleconego i ma prawo trwale wykluczyć Polecającego z Programu.
4. Organizator potwierdzi udział w Programie wysyłając wiadomość potwierdzającą do Polecającego.
5. Organizator zastrzega sobie prawo odmowy przyjęcia zgłoszenia do Programu w przypadku uzasadnionego podejrzenia nadużyć lub sprzeczności z zasadami Programu.

§3 Nagrody i rozliczenia

1. Nagroda dla Polecającego jest naliczana jako prowizja od wartości netto usług zakupionych przez Poleconego wyłącznie w zakresie usług wymienionych w §2 ust. 6.
2. Do wartości podstawy naliczania prowizji nie wlicza się rabatów, opłat manipulacyjnych ani kwot zwróconych.
3. W przypadku odstąpienia Poleconego od umowy, rozwiązania umowy, częściowego lub całkowitego zwrotu wpłaconej kwoty – prowizja nie przysługuje. Jeżeli prowizja została już wypłacona, Organizator ma prawo żądać jej zwrotu w całości lub w odpowiedniej części proporcjonalnie do zwrotu dokonanym Poleconemu.
4. Polecający powinien mieć na uwadze, że uzyskana nagroda może stanowić jego przychód w rozumieniu przepisów prawa podatkowego. W takim przypadku Polecający samodzielnie odpowiada za ewentualne rozliczenie z właściwym urzędem skarbowym.
5. Nagrody wypłacane są przelewem bankowym na rachunek wskazany przez Uczestnika w terminie do 45 dni od spełnienia warunków określonych w Regulaminie.
6. Organizator może ustalić maksymalną łączną kwotę nagród w wysokości 50’000 zł miesięcznie dla wszystkich uczestników Programu. Informacja o limicie publikowana jest na stronie internetowej Organizatora.

§3a Skala prowizji

Do liczby skutecznych poleceń wliczane są wszystkie polecenia od momentu przystąpienia do Programu. Organizator potwierdza aktualny poziom prowizji drogą elektroniczną (e-mail/WhatsApp).

§3b Przykładowe wyliczenie prowizji

1. Polecający przekazał kontakt do 2 osób. Każda z nich kupiła usługę o wartości 2 000 zł netto. Obowiązuje poziom 1 (1–3 polecenia) → prowizja = 10%. Obliczenie: 2 000 zł × 10% × 2 osoby = 400 zł nagrody.
2. Polecający przekazał kontakt do 6 osób. Każda z nich kupiła usługę o wartości 1 500 zł netto. Obowiązuje poziom 2 (4–9 poleceń) → prowizja = 12%. Obliczenie: 1 500 zł × 12% × 6 osób = 1 080 zł nagrody.
3. Polecający przekazał kontakt do 12 osób. Każda z nich kupiła usługę o wartości 3 000 zł netto. Obowiązuje poziom 3 (10+ poleceń) → prowizja = 15%. Obliczenie: 3 000 zł × 15% × 12 osób = 5 400 zł nagrody.

W przypadku gdy Polecony kupuje kilka usług, prowizja liczona jest oddzielnie od każdej usługi i sumowana. Do prowizji nie wlicza się rabatów, opłat manipulacyjnych ani kwot zwróconych.

§4 Ochrona danych osobowych

1. Administratorem danych osobowych uczestników Programu jest The Burman Robinson Sp. z o.o.
2. Dane Polecającego i Poleconego przetwarzane są wyłącznie w celu realizacji Programu oraz świadczenia usług przez Organizatora.
3. Polecony, którego dane zostały przekazane, otrzymuje informacje o źródle pozyskania danych oraz ma prawo dostępu, sprostowania i żądania usunięcia danych zgodnie z RODO.
4. Szczegółowe zasady przetwarzania danych znajdują się w Polityce Prywatności dostępnej na stronie Organizatora.

§5 Postanowienia końcowe

1. Udział w Programie jest dobrowolny.
2. Organizator zastrzega sobie prawo do zmiany regulaminu w dowolnym czasie. Zmiany regulaminu publikowane są na stronie internetowej Organizatora i obowiązują od dnia publikacji.
3. Aktualny regulamin dostępny jest na stronie internetowej Organizatora.
4. W sprawach nieuregulowanych regulaminem mają zastosowanie przepisy prawa polskiego.

 

REFERRAL PROGRAM REGULATIONS

§1 General Provisions

1. The organizer of the Referral Program (“Program”) is The Burman Robinson Sp. z o.o. with its registered office in Warsaw, entered into the National Court Register (KRS: 0000750545), NIP: 5252764840, hereinafter referred to as the “Organizer.”
2. The Program is addressed to natural persons of legal age who have full legal capacity.
3. The purpose of the Program is to reward individuals for recommending the Organizer’s services to their friends and acquaintances.
4. The Program is valid until revoked by the Organizer.

§2 Rules of Participation

1. A Participant of the Program (“Referrer”) may take part in it by providing the contact details of a third party (“Referred Person”) interested in the Organizer’s services.
2. The Referred Person must:
   1. be a new Client of the Organizer (not previously registered in the system),
   2. use a paid service of the Organizer and fully pay for it.
3. A referral is considered successful if the Referred Person signs an agreement with the Organizer and makes full payment.
4. The Organizer confirms fulfillment of the conditions electronically (via e-mail/WhatsApp).
5. The Program does not cover referrals of oneself, family members, or persons already listed in the Organizer’s client database.
6. The Program applies exclusively to referrals concerning the following services:
   1. obtaining temporary / permanent residence permits or citizenship,
   2. registration, amendments, or liquidation of a sole proprietorship or company.

   Referrals for other services are not included in the Program in a given month.

§2a Joining the Program

1. Any natural person meeting the conditions specified in §1.2 may join the Program, regardless of whether they are a Client of the Organizer.
2. To join the Program, one must:
   1. declare their intention to participate by sending an e-mail or WhatsApp message to the Organizer,
   2. read these Regulations and accept their content, with acceptance possible in one of the following forms:
      • selecting the appropriate checkbox in the online form,
      • sending an e-mail or WhatsApp message confirming acceptance of the Regulations,
      • providing the first referral, which is deemed equivalent to accepting the Regulations.
3. If the Referred Person reports that their data was provided without consent, the Organizer will delete the Referred Person’s data and may permanently exclude the Referrer from the Program.
4. The Organizer will confirm participation in the Program by sending a confirmation message to the Referrer.
5. The Organizer reserves the right to refuse participation in the Program in the event of justified suspicion of abuse or violation of the Program rules.

§3 Rewards and Settlements

1. The Referrer’s reward is calculated as a commission on the net value of services purchased by the Referred Person exclusively within the scope of services specified in §2.6.
2. Discounts, administrative fees, and refunded amounts are not included in the commission base.
3. In the event of withdrawal from the contract, termination of the contract, or partial or full refund to the Referred Person – the commission does not apply. If the commission has already been paid, the Organizer has the right to request its full or partial return proportionally to the refund made to the Referred Person.
4. The Referrer should be aware that the reward received may constitute income under applicable tax laws. In such case, the Referrer is solely responsible for any settlements with the relevant tax office.
5. Rewards are paid by bank transfer to the account provided by the Participant within 45 days of meeting the conditions specified in the Regulations.
6. The Organizer may set a maximum total reward amount of 50,000 PLN per month for all Program participants. Information on such limits will be published on the Organizer’s website.

§3a Commission Scale

The number of successful referrals includes all referrals made from the moment of joining the Program. The Organizer confirms the current commission level electronically (via e-mail/WhatsApp).

§3b Example Commission Calculations

1. The Referrer provided contact details of 2 people. Each purchased a service worth 2,000 PLN net. Level 1 applies (1–3 referrals) → commission = 10%. Calculation: 2,000 PLN × 10% × 2 people = 400 PLN reward.
2. The Referrer provided contact details of 6 people. Each purchased a service worth 1,500 PLN net. Level 2 applies (4–9 referrals) → commission = 12%. Calculation: 1,500 PLN × 12% × 6 people = 1,080 PLN reward.
3. The Referrer provided contact details of 12 people. Each purchased a service worth 3,000 PLN net. Level 3 applies (10+ referrals) → commission = 15%. Calculation: 3,000 PLN × 15% × 12 people = 5,400 PLN reward.

If the Referred Person purchases multiple services, the commission is calculated separately for each service and summed up. Discounts, administrative fees, and refunded amounts are not included in the commission.

§4 Personal Data Protection

1. The administrator of personal data of the Program participants is The Burman Robinson Sp. z o.o.
2. The data of the Referrer and the Referred Person is processed solely for the purpose of implementing the Program and providing services by the Organizer.
3. The Referred Person whose data has been provided will be informed about the source of data collection and has the right to access, rectify, and request deletion of their data in accordance with GDPR.
4. Detailed rules for data processing are included in the Privacy Policy available on the Organizer’s website.

§5 Final Provisions

1. Participation in the Program is voluntary.
2. The Organizer reserves the right to amend these Regulations at any time. Changes to the Regulations are published on the Organizer’s website and are effective from the date of publication.
3. The current version of the Regulations is available on the Organizer’s website.
4. Matters not regulated by these Regulations are governed by Polish law.
